These Terms of Service (“Terms”) govern your access to and use of our website, listings, services, and related tools (collectively, the “Services”). By using 928411.com, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.

    1. Acceptance of Terms

Users may browse listings, submit their business for inclusion, purchase premium placement options, and claim existing listings. Services may include communication via email or SMS related to your account or listings.

    3. Account Registration

    To submit or manage a listing, you must create an account using your email address, Facebook, or Google login. You agree to provide accurate and complete information and keep your login credentials secure. You are responsible for all activity on your account.

    4. Listing Submissions & Claims

    By submitting a listing or claiming an existing one, you certify that you have the authority to represent the business. You agree that:

    • All listing content must be accurate and lawful.
    • You grant us a non-exclusive license to use submitted content to display, market, and share the listing.
    • We may reject, edit, or remove any content at our discretion.

    5. Payments & Refunds

    All premium upgrades, including featured listings and badge placements, are paid services processed securely through Stripe. Payment is due in full at the time of order.

    Refund Policy: All purchases are final. We do not offer refunds for listing upgrades, digital placements, or promotional services. Please ensure your business details are accurate before submitting. In the event of a billing error, contact support@928411.com for resolution.

    6. Use Restrictions

    You agree not to:

    • Use the Services for unlawful, deceptive, or harmful purposes.
    • Impersonate another individual or business.
    • Scrape, copy, or republish content without permission.
    • Attempt to breach or bypass security features of the platform.

    Violation of these rules may result in immediate termination of access.

    7. Integration with nineXtwelve

    928411.com integrates with nineXtwelve.com for premium listing visibility, including the exclusive 9×12 postcard program. By reserving a qualifying listing, you may be invited to participate in related promotional campaigns. All terms related to postcard advertising are governed by NineXtwelve’s separate Terms and Conditions.

    There is no conflict between platforms; 928411 serves as the digital directory and community companion to NineXtwelve’s physical mail campaigns.

    8. Intellectual Property

    All website content, including logos, designs, and layout, is the property of NineXtwelve LLC. You may not reproduce or distribute any content without prior written consent.

    9. Termination

    We reserve the right to suspend or terminate access to the Services at any time, without notice, for violation of these Terms or conduct we deem harmful.

    10. Disclaimers

    The Services are provided “as is” without warranty of any kind. We do not guarantee traffic, leads, or sales from directory listings or promotional placements.

    11. Limitation of Liability

    To the fullest extent permitted by law, NineXtwelve LLC shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services.

    12. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved exclusively through binding arbitration conducted in Mohave County, Arizona, in accordance with the rules of the American Arbitration Association. By using the Services, you waive any right to a jury trial or participation in class actions.

    13. Severability

    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
